Al Asher infrastructure Pvt. Ltd. is an infrastructure company that is located across United Arab Emirates. Company’s main business is to develop the infrastructure of the region in coordination and collaboration with the government of the region. Company, in its employment contract, clearly specifies that the company handles major projects which is divided into smaller parts known as task. These tasks are allotted to the employees of the company and they are required to accomplish these tasks within the time period being allotted to them by the company. Most of the times, depending on the project’s length and the time period being allotted to the company to complete the overall project, it is often required that employees of the company are required to work for some extra time so as to ensure that the day’s planned work is completed by the employee as per his schedule i.e. an employee cannot leave the task incomplete even when the working time is over.
The policy of the company most of the times goes against the UAE labour laws as article 65 of the UAE Labour Law has set the number of working hours per week at 48 hours or 8 hours per day, and employers who compel workers to exceed this limit without paying them are violating labour rules.
However, since Al Asher company has allotted task as per schedule to the employees, it does not pay the employees for the extra time they spend on the field as company believes that it is the employee who is responsible for his extra hour working and not the company.
