Absolute rights are those rights that can not be restrained or restricted under any condition. Therefore, right to privacy can not be considered absolute because of the fact that right to privacy might be infringed upon a probable cause. Therefore, this makes right to privacy a fundamental right and not an absolute right.
Right to privacy was recognized by the supreme court in 1965 but is not explicitly included in the constitution of USA. The FIRST, THIRD, FOURTH, FIFTH AND NINTH amendments of US Constitution support the right to privacy. The privacy of beliefs is supported; the privacy of the home is supported by third amendment; the privacy of possessions and individuals against unreasonable search is supported by the fourth amendment; the privacy of personal information is supported by the ninth amendment.
According to the US law, in order to protect general welfare, right to privacy is subject to reasonable restrictions. Right to privacy can not deter the state from making laws that impose reasonable restrictions on the general public. Therefore, right to privacy is one of the fundamental rights
