(1) what is the fundamental right to privacy
Under Article 12 of the Universal Declaration of Human Rights 1948, a fundamental right to privacy is specifically stated: no one shall be subjected to arbitrary interference with his or her health, family, home or correspondence, nor to attacks on his or her honor and reputation. The right to privacy also means the right to personal liberty, or the right to choose whether to participate or not in other activities or to have any experience. The Fifth Amendment safeguards against self-incrimination, which in effect preserves personal data privacy.

(2) what laws provide a right to privacy in the private sector;
The privacy rights of workers include sensitive details and behavior of an employee at work. Private-sector businesses, and not operating under a government contract, have certain legal responsibilities towards their workers, but also corporate policy can determine much of the privacy rights of an employee. The law covers only the personal information kept by government departments, not private companies. Private employers are responsible for behaving in good faith with details about an employee. Only a tribunal may request personal information to be released. The Texas Workforce Commission recommends following a couple of rules to ensure sensitive information is safe. View all personal information as private and confidential including the personal characteristics, family and friends of an employee. Disclose employee details only to those who need it for legitimate or legal reasons. Investigate all information requests, maintain documents and use permission for disclosure forms. Store confidential documents safe, and scrap old papers. Send nothing with a Social Security Number, except approved forms of government specified in Texas state law.

A private company is allowed to control the use of its employees by phone, computer and email. It is advisable that workers are clearly identified, recorded and given written acknowledgment of all monitoring policies. When computer and email management policies are in effect, they will state explicitly that workers should not deserve privacy when on company property or while using company services. A private corporation may have a policy which allows it to search for an employee, the office of an employee or the property of an employee, including a vehicle, if it is on the property of a corporation. That being said, a personal quest can lead to a number of litigation against an employer. Bodily searches are technically especially dangerous, and should never be carried out with intimidation. The Texas Workforce Commission suggests that employers take extreme care when approving or carrying out personal searches.
