Who is ultimately responsible for the fatal design flaw?

Solution -
During any project, the maximum amount of time is devoted to the planning phase, during which the detailed drawing are prepared and all the variable are considered. There is no one particular person responsible for any particular activity. Each activity undergoes numerous tests and stimulations before any thing takes shape in real life.
The design engineer or company is given the responsibility to design the project as per the need of the client and this company will make sure that the project is feasible to it's best.
But the work done by them is closely monitored by a separate authority to foresee that the project is under specified limits.
So, in case of any fatal design flaw, the body looking after the work and the company who's design it was will be accountable because they are the one who made and approved that design and it was their responsibility that it should have been fatal proof.
The responsibility of a licensed professional engineer is to review the design and make changes if required to the design. It's his job to ensure that the design is as per need and not causing any harm or fail in future. once he/she is satisfied with the design, they can put their seal of approval to the fabricated drawings.
