Article 4 of ILO Convention 98 states that Measures appropriate to national conditions shall be taken, where necessary, to encourage and promote the full development and utilisation of machinery for voluntary negotiation between employers or employers' organisations and workers' organisations, with a view to the regulation of terms and conditions of employment by means of collective agreements.

It states that measures appropriate to national conditions shall be taken, where neccessary to encourage and promote the full development and utilisation of machinery for voluntary negotiation between employers or employers' organisations and workers' organisations with a view to the regulation of terms and conditions of employment by means of collective agreements.

Ways for Promoting collective baragaining

1. The promotion of collective bargaining by government and the parties should involve measures adapted to national conditions to promote collective bargaining and provide for the independent resolution of labour disputes. The goal of such measures is to:

  • allow collective bargaining to take place at any level, from single workplace , the organisation or firm, the occupation
  • ensure the both parties have access to the information required for meaningful negotiations

2. Collective bargaining at multiple levels

  • ensuring coordination between the various levels of bargaining
  • ensuring that their negotiators have the opprtunity to obtain appropriate training, including by requesting that public authorities assist in the provision of such training

3. By providing legislative framework and establishing supportive institutions. This includes dispute resolution machinery that facilitates bargaining

  • maintaining public databases on agreements concluded thus providing a valuable source of information for the social partners
  • maintaining statistics on the number and type of collective agreements and their coverage
  • offering dispute resolution services by labour authorities
