Abstract
The Service Employees International Union challenged the repeal
before the Ontario Divisional Court on the basis that it
contravened sections 15 and 28 of the Charter of Rights and
Freedoms.
The Court agreed with the Union and ruled that the repeal was
unconstitutional and of no force and effects.
Importance of
Ontario pay Equity Act - Which leads it to be one of the most
progessive pieces of pay equity legislation
- Ontario has legislation called the Pay Equity Act to ensure
that employers pay women and men equal pay for work of equal
value.
- This means that men and women must receive equal pay for
performing jobs that may be very different but are of equal or
comparable value.
- The Pay Equity Act requires employers to identify and correct
gender discrimination that may be present in their compensation
practices and to adjust the wages of employees in female job
classes .
- So that they are at least equal to the wages of employees in
male job classes when they are found to be comparable ..
- The Pay Equity Act applies to all employers in the public
sector and all employers in the private sector who employ 10 or
more employees. This includes employees who are employed on a
full-time, part-time and seasonal basis.
- Employees expect a fair return for what they contribute to
their jobs, a concept referred to as the "equity norm".
- Employees determine what their equitable return should be after
comparing their inputs and outcomes with those of their coworkers
i.e.social comparison.
