Identify and describe the three principal rights of a worker that provide the basis for much of the health and safety legislature in Canada. Give an example of each of these rights. Ensure to properly address the question with references and material from this lesson. Answer should be minimum 1 page. The responsibilities of governments, employers and workers should be seen as complementary and mutually reinforcing in the task of health and state legislature in canada,to the greatest extent possible within the constraints of national conditions and practice.It is very essential that the workers' should have the fundamental right for the protection of life and health at work.So following are the rights :
RIGHT TO KNOW -All employees have a right to know what hazards are present on the job, and how these hazards can affect them. Learning about chemical safety through WHMIS - the Workplace Hazardous Materials Information System - is also part of the "right to know" system.Employers are required to provide the information, training, and supervision a worker needs to avoid being hurt by hazards in the workplace.For example-If the workers are doing work in the area where the fuel and fire like materials are used ,they need to know about safety rules of that place.
RIGHT TO PARTICIPATE-All employees have a right to take part in health and safety activities.. With this right comes a worker’s responsibility to report all hazards to their employer, without fear of reprimand, reprisal, or punishment.. For example, you can be chosen to be a health and safety representative or a member of a committee.They have right to report unsafe practices and conditions without worrying about losing their job if they get in trouble .
RIGHT TO REFUSE -All the workers have the right to refuse the dangerous work that they believe is unsafe to themselves or their coworkers. The right to refuse is provided so that a worker never needs to compromise between their health and safety and having a job.It is not up to the worker to prove whether their belief is justified. For example-if a worker is doing work with a machine and due to some false working of that machine he can be injured ,then he can refuse to do that work.
