For this assignment, you are an HR manager for ABC corp. The director of sales would like you to give a presentation to her team of seven sales managers about the importance of creating a legally defensible job description. This is a good time to present to the team given that there will be a surge of new positions on the sales team that do not yet have job descriptions created.

Answer the following questions:

  1. Include information of three examples of unlawful job requirement criteria.
  2. Discuss why the examples identified are unlawful.
  3. Discuss the ramifications of listing unlawful job requirement criteria on job descriptions.
  4. Then give three examples of criteria that are legally satisfiable instead.

Three examples of unlawful job requirement criteria.

(a) The applicant must be under 35 years of age as the position requires youthful vigour in the successul candidate

(b) The applicant must be physically strong to protect himself from strong air currents, common for this position. The company does not take responsibility for damages caused by air currents caused by the running machines.

(c) The applicant must not be an asian, or a Mohammadan by religion.

The first criteria violates the ADEA, hence it is unlawful. The second criteria violates OSHA guidelines, which mandates workplace safety guidelines. The third critieria violates the title VII clauses.

The ramifications might be seen in from of the candidates filing lawsuits against the company, the court taking self cognizance of the situation and the cedibility of the company in the work environment taking a hit.

Three saisfiable criteria.

(a) Since the physical conditions of work demand the person to be at least six feet tall, this position is suitable only for men who satisfy this criteria. The women over six feet can also apply.

(b) Th applicant for this position should never be convicted in any civil / criminal case by the court of law.

(c) The applicant for this position should have at least seven years practical experience of data processing in a company of repute.
