Subject: Analysis of the case of Mr. Robin's Worker's Compensation
Fund
The following is the analysis for the case of Mr. Robin and the worker's compensation claim he had asked for.
Legal Issue: Mr. Robin has filed for a worker's compensation
after breaking his leg playing golf, the membership of which is
provided by the organization.
So, is this incident is a personal issue or an accident at work and
hence Mr. Robin is liable for worker's compensation?
Explanation: Mr. Robin believes he is liable for worker's compensation because he had taken a client for the club and was between a meeting when he got injured. He believes he was working when he had been hurt and hence Springtime Manufacturing is liable for it.
Analysis: The membership fee is being paid by the organization and Mr. Robin had taken his friends along with him that day. Though he was meeting a client for work the entire meeting was an informal affair and he ideally hurt while playing for his benefits and not for the organization.
Facts: 1. Mr. Robin met a client at the club. 2. He had also taken along his friends and hence it was not completely a formal meeting. 3. The entire day was spent informally by eating, playing, and drinking.
In my opinion, Mr. Robin is not liable for worker's compensation because he has not been hurt in the premises of the organization. Even though the fees were paid for the club by the organization, they aren't liable to pay compensation to Mr. Robin.
Kindly let me know if something else is needed from my
end.
Warm Regards.
