To regulate how skilled nursing facilities (SNFs) treated residents. This law introduced restraint reductions |
SNFs that needed to become free of restraints Residents who no longer were tied to beds or chairs |
The public did not tolerate the way older adults were cared for in SNFs. This law pushed for many reforms in SNFs including the need for the patient and/or their family to be involved in care conferences. Most notably, it is the legislation that started the move to be restraint free both physically and chemically. (This meant that medications could not be used as a restraint along with the reduction in posey ties and other restrictive belts) |
Personal restraints need to be continually monitored for each patient in an SNF. Perhaps there should be an addition to the MDS documentation completed on each resident to note that restraints are not used. |

What was the purpose for this laws
High premiums and deductibles caused patients to spend lot of
dollars each year on coverage without any benefits..life time and
annual limits exposed people to economically affordable with
medical bills that they would be permanent..

It affects all federal individual income tax returns filled in 2015
for the 2014 calendar year and to bethe premiums and
penalities
Why was this law needed?
It increased coverage and medicaid eligibility..it increased the
deficit and that law reduced income inequality..it also enacted a
host of delivery system reforms intended to restrict the healthcare
costs and improve quality..
What revisions might be needed in the future:
the individual mandate was repeated starting in 2019 through the
Tax cuts and jobs Act of 2017..The CBO estimated that the repeal
would cause 13million people to lose their health insurance by
2027,so it reduce the causes of the rising costs of health
care
Emergency Medical Treatment and Active Labor
Act
(EMTALA)

1986
What was the purpose for this laws?
this act for people who need medical emergency,like injury or
active birth,the law obligates caregivers to stabilize the patients
and provide treatment..it is not directly covered by the federal
government
who does this law affect most?
Patient treated under EMTALA may not be able to pay or have
insurance or other programs
why was this law needed?
It provides right equally,regardless of age,race
religion,nationality,ethnicity,residence,citizenship or legal
status
What revisions might be needed in the future
In future they are planning for long-term care or rehabilitation
facilities for patient unable to provide self care.as per centers
for medicare and medicaid services,55% of US emergency how goes
uncompensated..
The health Information Technology for Economic and clinical
health Act(HITECH)

What was the purpose for this laws
It established grants for training centers for the personnel
required to support new health IT infrastruture in health care
organization

HITECH act under social security act (SSA) regarding noncompliance
due to willful neglect,requiring HHS investigate any complaints
that violate due to willful neglect and to impose penalities on the
violations

It promotes health information technology..it improve healthcare
quality,safety and efficiency

CMS announced in mid -2014 upto 2017 HIPAA security risk assessment
will be in future ..
