Have you ever been misled into an agreement? Do you think there was any fraud or misrepresentation or simply “puffing”? Please describe the situation and the outcome.
I have been misled into an agreement quiet a few times.
Example:
Mobile phone call Service coverage:
I moved to new place to support my job requirement. My existing mobile phone call service provider do not operate at new place where I recently moved. Therefore, I decided to opt for new local call service provider. When I approached local call service provider, I was being told that this local call servicer provider has a good coverage in the areas where I live and it also provides 4G network which is fast and efficient.
I purchased a 12 month plans and paid Rs.5000 and isgned the contract to become the member. However, when I started using the service from this local provider, I found freqent call drop, I found no internet coverage, very slow speed of data download.
I consider this as breach of contract and guiding the false information.
Outcome:
I initially raise the concern to the local service provide help booth. However, I did not get the satisfied answers. Then I went to consumer court and filed a case against the Service provider. Consumer court accepted my appeal and after verification court identified local service provider as culprit. Court summoned to Service provider to pay me the full contract fees as well surplus amount for emotional harrassment. Court ordered local service provider to install 2 tower in the area to have effective call service
