Initial Question: The structure of the criminal justice system is designed to have three separate branches: the legislative branch, the executive branch and the judicial branch. Police officers, which fall under the executive branch of the criminal justice system, have the authority to use discretion when interacting with the citizens within the communities in which they serve. Do you think that police abuse their power of discretion or fail to use it? Please explain your answer.

We are living in the society safely and securely because of police department. The department plays a great role in controlling the crime and providing peaceful life to the people. They work round the clock in preventing the crime and its defaulters.

Every country consists police department and they are legally authorised to use such force and other laws to control the crimes in the society. They are best in implementing the various laws that are formed to follow by the people of the country and police work accordingly in executing such laws. There are so many functions and sub divisions in the police department to control various crime related issues in the society. The basic duty of the police department is find the criminals, arrest, lodge a complaint(FIR), investigation, taking the criminal to court and providing punishment all these duties has to be performed by the police department.

This is not an easy job to any individual to perform. There are so many trainings are provided and conduct various assessments to get the police job. One has to go with multiple trainings on physical, mental and other knowledge to work in the department. Without completing training and other learnings on various crimes no one is allowed to perform the job.

The police are always trained in such a way to behave good with the people of the society because they are trained in such a way to control society and people in the good manner and good conduct.

Not everyone very few of them lose their control and behave differently due to the uncontrolled situation. few of them fail to use the discretion when interacting with citizens that is due to the lack of self-control and improper training. But most of them behave and good with the people while interacting.

They are the only people who have the right to punish the person if found guilty. They are trained in such a way that they should behave good and be nice with the people while interacting or investigating. No one is punished until he/she found guilty.

There are few people especially the new recruited people in the department fail to use the power of discretion. Because of the inexperience and inability to understand the department. Whereas the other are best in doing their duty by following the guidelines and right way of behaving with the people.

Mostly, the new recruited and young blood make them do the duty strongly in which they fail to use the power of discretion. Once they start and interact than they will be able to understand the role and responsibility of the police department.
