Choose one existing incumbent that is being beaten by a challenger in business. In other words, identify and choose one incumbent that is struggling to survive in the market. Conduct a thorough analysis of the current conditions of this incumbent by referring to following relevant strategic analysis frameworks:
1. Porter’s Five Forces Model (refer to lecture 7) a. Degree of existing rivalry b. Threat of potential entrants c. Bargaining power of suppliers d. Bargaining powers of buyers e. Threat of substitutes
2. Stakeholders analysis (refer to lecture 7) a. Strategic stakeholder analysis b. Normative stakeholder analysis
3. Porter’s Value Chain Model (refer to lecture 7) a. Primary activities b. Support activities
4. PESTEL (Political, Economic, Social, Technological, Environmental, Legal),
5. SWOT (Strength, Weaknesses, Opportunities and Threats)
6. Technology cycle (refer to lecture 4) a. Era of ferment b. Era of incremental change
7. The Utterback and Abernathy Model or 3 Phases of innovation model (refer to lecture 4) a. Fluid Phase b. Transitional Phase c. Specific Phase
8. The McKinsey 7-S Model a. Hard elements (Strategy, Structure, System) b. Soft element (Shared Values, Skills, Style and Staff) .
Use at least 4 strategic analysis frameworks, identify and evaluate the current position of the incumbent and synthesize the findings. The first one (Porter’s Five Forces Model) is compulsory. In technology cycle and 3 phases of Innovation model, explain at which phase does the current position of the incumbent of our choice fall on. After assessing the incumbent’s current position, provide a detailed solution for this incumbent to re-emerge in the market. The solution has to be linked to innovation and new disruptive technologies. This will help to explain about the firm’s strategic intent. This solution should help to identify and explain the resources and capabilities required by the incumbent that helps to close the gap between its current position and its strategic intent. As part of the assessment, create a mind map to show the possible solutions.

2. Write a DOWNWARD letter to your employees regarding the actions, decisions, consequences of your decision and how it affects them personally. Make sure to convey your decision.
3. Be thorough in your letters. Include details; be vigilant with spelling, punctuation, grammar, etc. Use Times New Roman, 12 point font, and 1 inch margins.
This case was written by Geoffrey P. Lantos, Stonehill College. Permission to reprint granted by Arthur Anderson & Co. SC. p. 842
Something’s Rotten in Hondo
George Mackee thought of himself as bright, energetic and with lots of potential. “So why is this happening to me?” he thought. George, with his wife, Mary and his two children, had moved to Hondo, Texas, from El Paso four years earlier and was now the manager of the Ardnak Plastics plant in Hondo, a small plant that manufactured plastic parts for small equipment. The plant employed several hundred workers, which was a substantial portion of the population of Hondo. Ardnak Plastics Inc, had several other small plants the size of Hondo’s. George had a good relationship with Bill, his boss, in Austin, Texas.
THE EMISSIONS PROBLEM
One of the problems George’s plant had was that the smokestack emissions were consistently above EPA guidelines. Several months ago, George got a call from Bill stating that the EPA had contacted him about the problem and fines would be levied. George admitted the situation was a continual problem, but because headquarters would not invest in new smokestack scrubbers, he didn’t know what to do. Bill replied by saying that margins were at their limits and there was no money for new scrubbers. Besides, Bill commented, other plants were in worse shape than his and they were passing EPA standards.
A QUESTIONABLE SOLUTION
George ended the conversation by assuring Bill that he would look into the matter. He immediately started calling his contemporaries at other Ardnak plants. He found they were scheduling their heavy emissions work at night so that during the day, when the EPA took their sporadic readings, they were within standards. George contemplated this option, even though it would result in increasing air contamination levels.
THE DOUBLE BIND
A month went by, and George still had not found a solution. The phone rang; it was Bill. Bill expressed his displeasure with the new fines for the month and reminded George that there were very few jobs out in the industry. That’s when Bill dropped the whole thing into George’s lap. Bill had been speaking to the Mexican government and had received assurances that no such clean air restrictions would be imposed on Ardnak if they relocated 15 miles south of Hondo in Mexico. However, Ardnak must hire Mexican workers. Bill explained that the reason for relocating would be to eliminate the EPA problems. Bill told George he had one week to decide whether to eliminate the fines by correcting the current problems or by relocating. George knew that relocating the plant on the Mexican side would devastate the infrastructure of the city of Hondo and would continue to put contaminants into the air on the U.S. side. When he mentioned the possibility to Mary, she reinforced other concerns. She did not want him to be responsible for the loss of jobs of their friends and extended families.

Write a Case Brief on one of the following cases in a similar format to the example case brief below. (Please write in format where I can copy and paste)
EXAMPLE CASE BRIEF:
Rael v. Cadena, 93 N.M. 684, 604 P.2d 822 (Ct. App. 1979)
Parties:
Eddie Rael, Plaintiff‐Appellee
Emilio Cadena and Manuel Cadena,
Defendants‐Appellants
Prior Proceedings:
Eddie Rael sued Emilio and Manuel Cadena for civil battery. The trial court, sitting without a jury (bench trial), found Emilio jointly liable with Manuel for the battery. Emilio appealed the judgment of the trial court.
Facts
While visiting Emilio Cadena’s home, Eddie Rael was beaten by Emilio’s nephew, Manuel Cadena. After the attack began, Emilio yelled to Manuel “kill him!” and “hit him more!” Emilio never actually struck Rael nor physically participated in the battery. Rael was hospitalized as a result of the beating.
Issue
Under New Mexico tort law, does liability for battery arise when an individual, present during the battery, encourages the perpetrator of the battery by yelling “kill him” and “hit him more” thus inciting the perpetration of the battery though he takes no actual part in the physical beating?
Rule
Yes. An individual may be liable for battery by encouraging or inciting the perpetrator by words or acts.
Analysis/Reasoning
The rule of law in the United States is: Civil liability for assault and battery is not limited to the direct perpetrator, but extends to any person who, by any means, aids or encourages the act. The act of verbal encouragement at the scene may give rise to liability because the perpetrator is goaded and encouraged at the behest of the person encouraging the battery. Here, Emilio encouraged Manuel to beat Rael and to continue to beat him. The battery may not have occurred or continued but for Emilio’s encouragement. Therefore, Emilio had some part in the beating even though he never physically contacted Rael. Thus, Emilio is liable for the battery for aiding in its commission and encouraging the act.
Conclusion (holding/disposition)
The judgment against Emilio Cadena is affirmed.
