INTRODUCTION :- Consent,a very important thing which hold a peculiar place in an individual's life.It provides him the right,that if he does not like anything,or something is happening to him,without his very consent,that is without his willingness,then he may ask others to stop doing from it.In the medical field,this is one of the prominent aspect,as with the consent of patient,the doctors further continues their entire procedure of treatment.On the contrary,if the patient disagrees or does not provide his consent,it is quite impossible for the clinicians to continue with their work.
Even though the consent of patient is highly superior,yet there are certain cases,where it's legally and ethically appropriate for health professionals to proceed with a treatment without the consent or proceed with the treatment that is against patient decision.It generally happens in such a situation,where the doctors have complete faith on themselves that they will be able to deal with the case in more effective manner,and not only this but will even come up with the positive result,that is with the betterment in the condition of the patient.There are some situations where due to certain bad phases of life,or due to some crisis,specifically in terms of money,the patient does not provide his consent regarding his treatment,but the doctors being aware that the patient can be cured,goes ahead with the procedure of treating him,so that his health can be recovered.And considering the intention of doctor it is completely right in terms of legally as well as ethical aspect
An example of this situation,where doctors treating the patient without patient being agree with it,could be a case of suicide where the individual is willing to give away his life,as he is not able to deal with it anymore,as such he felt that it could be best for him to end himself.When taken to hospital he was being saved,with immediate actions being taken by the doctors,but still he requires some major treatment which includes surgery,which will makes his condition better and within some time he will be all fine,but as such it requires the consent, the patient clearly disagrees with it,so in that condition,if the doctors goes beyond the thoughts or decision of patient,and keeps his work of treatment ongoing,as he is well aware,that surgery will only do good to the patient,therefore,in that condition it is legally appropriate for the doctor to avoid the consent of patient.
In my opinion,it is completely right on the part of the doctor to carry forward his work.Moreover in situations,where the doctor is himself unsure of the outcome,and knows that doing this will risk his life,then it will be wrong on his part,but here the condition is entirely different as doctors have faith on their ownself that the result will be positive,so ,therefore it correct on the part of doctors,to continue the treatment,even if it means going against the decision of patient.
