With which of the goals of criminal sentencing do you most agree? Why? Which of the goals of criminal sentencing do you think individual-rights advocates would most likely find attractive? Which would public-order advocates favor? Why?
With which of the goals of criminal sentencing do you most agree? Why?
I would agree with incapacitation for severe crimes and restoration for minor crimes. People who have committed severe crime need time to calm down and think of the consequences their action caused on the victim and the victim’s family. So, when they are locked behind the wall, they will have time to meditate their action and decide not to commit it again.
For minor crime the restoration sentencing will help because the offenders will be able to work in the society as a punishment under the guidance of the court. So, they won’t be away from the society and their loved ones, instead repent for whatever they had done and at the same time serving the society they affected.
Which of the goals of criminal sentencing do you think individual-rights advocates would most likely find attractive?
Individual-rights advocates would find Deterrence goal to be more attractive as it proposes to prevent any crime with proper guidance from the criminal justice system. They would also support the restoration sentencing attractive too because people will have an opportunity to make amends for their offense by serving the community that was affected by their actions.
Which would public-order advocates favor? Why?
Public-order advocates will definitely support the retribution sentencing and incapacitation sentencing as they would keep the offenders away from the society thus ensuring safety and order in the society. For them order in the society and safety of the common people are very much important than few offenders locked up behind the bars.
