Contract violation means not sticking to the agreement taken place between two parties. On a smaller scale, contract violation takes place in our houses. For example, not paying the maid her salary which was decided before she joined.
Let's take an example,
The recent case of Ashok Kumar Khanna during Feb,2018 where the court wasn't able to decide whether the penalty should be in form of money. The opponent part M.C Luthura was found guilty of having broken the contract. So, according to the contract,he was supposed to pay a penalty to Ashok.
However, the case only held proofs of damages and losses and no strong evidence for violation of the contract. Still, the compensation has to be paid as per the rules and hence M.C Luthura did pay.
When it comes to contract violation, in cases like above,it's really difficult to judge whether the other party breach the contract or was it just situational. Sometimes it does happen that the party has to pay the penalty when he hadn't really violated the contract.
In some other cases, the contract gets violated but because some points weren't in written, nothing can be done about it.
For example, a employee joins a friend's company and as it's a matter of trust, he never asks for a written contract or anything. At the end of the month the employee doesn't get paid, and nothing can be done about it as there wasn't anything in written or no strong proofs.
