Discuss the constitutional evolution of British North America from the Royal Proclamation of 1763 to the British North America Act of 1867.
The Royal Proclamation of 1763: It was issued by King George III on October 7, 1763, following Great Britain's acquisition of French territory in North America after the end of the Seven Years' War. It forbade all settlement west of a line drawn along the Appalachian Mountains, which was delineated as an Indian Reserve.
British North America Act, 1867: This legislation, passed by the British Parliament, created Canada as a new, domestically self-governing federation, consisting of the provinces of New Brunswick, Nova Scotia, Ontario and Quebec, on July 1, 1867.
What were the most important features of each constitution?
The Royal Proclamation of 1763: This constitution prohibited American colonists from settling west of Appalachia.
The Treaty of Paris, which marked the end of the French and Indian War, granted Britain a great deal of valuable North American land through this proclamation
British North America Act, 1867: The act served as Canada’s “constitution” until 1982, when it was renamed the Constitution Act, 1867, and became the basis of Canada’s Constitution Act of 1982, by which the British Parliament’s authority was transferred to the independent Canadian Parliament.
Why did the British keep changing the constitutions?
British kept changing the constitutions because the Royal Proclamation of 1763 ceased to be a major source of tension after 1768, since the later treaties opened up extensive lands for settlement.
Also, colonial resentment of the proclamation contributed to the growing divide between the colonies and the mother country.
What is your overall assessment of the relationship between the British empire and the peoples of Canada?
The provinces of British North America became a federation called Canada. Canada ruled itself, but was closely linked to the British empire through trade and industry and also through strong links between Canadians and their families in Scotland, Ireland, Wales and England. They estabilshed a good relationships.
