The different types of laws which will be applicable to this organization are
FLSA (Fair Labor Standards Act); the Labor Management Relations Act (LMRA) and ERISA (Employee Retirement Income Security Act. These laws and regulations will regulate and monitor the human resources practices and processes which are adopted by the organization.
FLSA (Fair Labor Standards Act) is a federal law which is passed by the Congress of the USA and this law covers each employee who is actively participating in interstate commerce or working in any organization which is performing its normal course of business activities in the commerce industry. While determining the human resource related processes and policies, it is mandatory for the organization to incorporate all the norms and guidelines stated in FLSA (Fair Labor Standards Act);. The main provisions of this act are minimum wages to all the manpower, prohibition on child labour, prohibition of oppressive child employment, overtime of ‘time-and-a-half’ in specific jobs.
The earlier name of the Labor Management Relations Act (LMRA) was NLRA (National Labor Relations Act). This act consists of different employee’s rights along with the rights of the employers. As per this act, the guidelines are provided for the peaceful and orderly solution of interferences of any parties’ legitimate rights by another party.
In case of ERISA (Employee Retirement Income Security Act), the main focus remains on providing various guidelines to the HR department for the various rights of the manpower to receive the different types of benefits for example gratuity, health insurance, pension plan and so on.
