Legal issues that commonly arise in an Individual support setting:
Individual support settings refers to the settings, where the aged and disabled people gets the support and care . The common individual support settings are acute care centers , home for aged, day care centers , long-term care centers etc. The two major legal issues, that commonly arise in individual support settings are :
* Abuse and neglect within the individual support settings especially in Aged care facility : A common legal issue , that arise from Individual support setting , is the abuse and neglect by the workers or health care providers. Abuse is the improper treatment or usage or the insulting speech or physical maltreatment. Negligence is the tort , by a health worker , where by a duty of reasonable care was breached . causing damage to the patient or the client.
* Use of restraints and lack of resources: Overuse of restraints in the Individual care settings are a common legal issue . According to the Government health department and regulatory bodies' rules and regulations, the use of restraints are restricted in support settings, Use the restraints, only as a last resort, in situations, in which, patient may cause harm. to himself or others.
In case of restraint using,monitor the restraints and the patient regularly. Check the blood supply of the site and movement capacity.
Lack of resources is another major legal issue pertaining to the individual support setting. Lack of Resources may include lack of adequate staffing, materials, recreational facilities, medical facilities etc.
