Stare decisis

Stare decisis means that court has to follow previously decided cases / historical cases while deciding on a current or future case."To stand by that which is decided" is a Latin term for Stare decisis.

Arguments that Roe v. Wade is settled law under the concept of stare decisis.

  • Abortion was illegal under the Texas law . Going for abortion was allowed only in case of mother's life in dangeour before Roe v. Wade case .
  • Although the abortion was against law in Texas the same restrictions were lifted in California and New York long before Roe v. Wade.
  • Griswold v. State of Connecticut, 1965 case law that established the right to privacy in case where medical procedures were involved, served as a legal precedent for Roe v. Wade.

From the above fact it can be cocluded that in Roe v. Wade case, court looked to past, similar issues to guide their decisions including the case Griswold v. State of Connecticut, hence was settled under the concept of stare decisis .
