Incorporation of written terms to a contract.

For making our written terms into a contract or to incorporate our terms and Conditions into a contract, they need to have been agreed at the Formation Point. Usually, we cannot include terms after the Formation Point unless the other party agrees. So here the other party should agree with our terms and condition and he or she should be willing to accept those written terms then only we can incorporate into a contract.

For incorporating the written terms into contract we can ask the party to sign the written agreement that declares that he is willing to make the contract like that. Or There would some situation occurs where we provide our Terms and Conditions to the other party and they are not agreed or rejected the offer and the parties act in a manner which shows they have been agreed. At this point also we can make a contract. And an other possibility is that it is not always needed that to sign on the particular terms and condition letter. The other party can express his willingness through other media also. So by doing this way we can incorporate our written terms to a contract.
