If Fair Work Australia is involved in a follow-up investigation of a dispute in the workplace, what are the stages in an investigation? Discuss in 120–150 words.
When a follow-up investigation of a dispute in the workplace arises, there are a numerous stages to an investigation; however, it will depend on what Fair Work staffs finds during the first stages as to whether the latter stages need to happen. The three stages are:
-- Assisted Voluntary Resolution (AVR): The inspector examined the AVR process to find that procedures are in place to ensure that employers are notified properly in regard to any transition from AVR to an investigation. It gives parties with an opportunity to resolve their dispute prior to mediation
-- Full investigation and compliance: The resolution process includes Fair Work Inspectors collecting information from the parties and producing a findings report that will have an impact on the compliance with Commonwealth workplace laws.
-- Enforcement: Based upon complaint analysis and the dictates of fairness and justice, national subject based compliance staff enforce the decision.
