There are many federal laws that require employers to pay workers’ wages on time & as per the contract accepted by both of them. Though there are several laws to protect labor welfare & compensation, there are incidents of violations or misuse of these laws. The fair labor standards act specifically prescribes standards of wages & overtime pay. It also cover overtime pay & wages for child labor & conditions. Apart from federal laws states & department of labor (DOl) have their own wage related laws.
There are several statewide issues related to wages, for example.
a) Nonpayment of wages or incorrect rate of pay
b) Disputes towards compensation for a working period
c) Nonpayment of wages during training or travel period
d) Failure to pay for overtime hours & unauthorized deductions from pay check.
Out of the above stated issues we will discuss two important issues.
Failure to pay for overtime:
This is a general issue in several industries which workers face with their employers. The fair labor standards act requires employers to pay nonexempt employees one & half times their regular wage for all hours above 40 hrs in a work week. . But in several cases employers have failed to pay their employees overtime payment. Sometimes there is a confusion when workers are not being paid on hourly basis many employers think that they are not required to pay for overtime which is not correct. Employers often withhold payment for overtime to force the worker to do something else. Employers also hold overtime pay if a worker resist some wrongdoing.
