Public health law is scattered through many legislative statutes and administrative documents which developed historically . Efforts to codify public health law may contribute to greater understanding and enforceability of the many separate pieces of legislation, judicial and administrative branches of government as well as in buisness , non governmental organizations and the community ,
According to Gostin_ public health laws are such legal forces and duties of organized society by which conditions for maintaing citizens health are ensured ,
The study of the legal powers and duties of the state to assure the conditions for people to be healthy (e.g to identify , prevent , andameliorate risks to health in the populations ) and the limitations on the power of the state to constrain the autonomy , privacy , liberty , proprietary or promotion of community heath.
Though this defination , Gostin's suggest the five essential characterstics of public health law;-
Government ;- public health is a special responsibility of government , in collaboration with partners in the community , business and the academic and media.
Population ;- public health focuses on the health of populations rather thab individual patients
Relationship ;- public health addresses the realtionship between the state and the popuation ( or between the state and individual who place themselves or thecommunity at risk)
Services;- public health deals with the provision of populations based services grounded on the scientific methodologies of public health ( e.g - biostatics and epidemiology)
Power;- public health authorities posses the powere to regualte indiviadual and businesses for the protection of tehcommunity , rather than relying on a near universal ethic of voluntarism.
