incompetent or unethical nursing conduct to the board.
common laws (Or)tort law:It was created by courts under judicial
decisions for individual cases..It includes patient Rights for
Refusing the treatment,negligence and malpractice ..This is more
familiar aw for nurses and doctors..Nurses are learned from school
about not only patient care and also leaned for right decisions to
maintain medical records and reports perfectly..
Public laws:It was designed to protect the public..For wrong
administration of drugs the crime against state the nurse could go
to jail and the license to practice will be closed..
Civil laws:It will be between the patient and nurse for wrong
procedure and practice the patient will receive some
compensation..
Legal practice for nurses:
Informed consent:It can be oral or written also..For special
procedure and treatement,high risk,alternative treatment,special
procedure and surgery consent must be obtained..It must be given by
client..In case patient in difficult ssituation to give consent
child can give if they are more than 18years..
Violence,abuse and neglect can be reported to the higher authority
with appropriate situation..
Potential liability for nurses should be addressed like physician's
order must be undrstand clearly..if you have doubt in order it must
be clarified with supervisors
Floating(unfamiliar with nursing unit) must be corrected by proper
orientation..Adequate staffing ratio for medical,critical and
paediatric unit..
To protect the nurses legally they must follow the education
resources for all aspects..As a nursing student they must do the
procedure under supervisor or doctors..As a nurse they must follow
the safeguards for client and avoid negligence acts..use common
sense for doing procedured what they learned,document the
medication and treatment in nurses records.
