After learning more about implied warranties and disclaimers, would you ever buy an item sold “as is”? Imagine a car salesman who offers you a car for $8,000, but who also says that he can knock the price down to $6,500 if you will buy the car “as is”. If you live in a state that does not give consumers special protections, which deal would be more appealing?
Suppose a car salesman offers me a car for $8,000 but who also says that he can knock the price down to $6500 if I buy the car “as is”. I would be hesitant in buying the car but would go ahead with it as even if the car shows some defaults then I can uphold the warranty of fitness that gives an implied warranty that the goods would be fit for the purpose.
In case, I live in a state that does not give consumers special protection, I would definitely not buy the car as it would be hard to make seller liable for any defaults in the car as he has given an implied warranty.
