What can staff nurses do to protect patients from quasi-intentional torts? Does this differ from the nurse manager's role in preventing quasi-intentional torts?
Quasi-intentional torts:
It is a wrongful act on speech commited by a
person or against to another person..
Nurses role:
Legal system made nurses are placed an increased
risk for a lwsuit..the laws that govern the nursing profession
common and statutory laws..nurses spend more time to document every
steps of care provided to the patient than implementation..Due to
stress and pressure nurses are tend to be liable to get respect and
consent from a client before performing care and informed consent
before a procedure..This type of torts are classified as
negligence(unintentional),Assault or Battery(intentional) that is
civil law..Than negligence assault can be defined as a attempt
threat of doing something..now a days nurses are so much involved
in lawsuits..giving more priority in informed consent..before doing
any procedure nurses must be make sure patient having knowledge
about the procedures..patient must be well known about
treatment, complication and outcomes..in emergency situation for
life saving treatment knowledge based practice protect nurse
against assault lawsuit..witness sigh can be given by patient or
their assigned proxy..Quasi-intentional tort comes under civil
law..
To protect the patient from risk always follow
institutional standards of care for practice..deligate procedure
should be done only by physicians..identify the patient problem and
risk and care them accordingly..Maintain a safe environmentand
document everything carefully..file incident reports like falls and
all with appropriate personnel and departments..
some time nurse managers be as a advocate for
patient's decision on the client if it is child those who are being
uninformed and their refusal to sign a consent form..Nurse can help
understand the situation by doing this..the nurse assumes her role
as the client's advocate and reduces their risk of any future risk
and helping client to amke an informed decision about their plan of
care..
