It is illegal if the employer discourages the employees for forming a union by terminating them from the organization as the labour unions are known to be betterment for the employees and for the workforce. If any employer terminates or fires the employee for forming or participating in the union then he or she is violating the Section 8 of the National Labor Relations Act (“NLRA”) and he or she is prohibitting the person from practicing the rights of Section 7 of the National Labor Relations Act (“NLRA”). Although the employer can place is views and opinions in this matter whether he supports or oppose the unions.

It is illegal if the employer asks the employees about their participation or the formation in a union and there is no obligation of the employee to disclose his affairs in any unions. The National Labor Relations Act (“NLRA”) protects the rights and interest of the labor and workers in the organization.
