Should there be a death penalty in a just society?

Should there be a death penalty in a just society?

Solutions

Expert Solution

  • When someone takes a life, the balance of justice is disturbed. Unless that balance is restored, society succumbs to a rule of violence. Only the taking of the murderer's life restores the balance and allows society to show convincingly that murder is an intolerable crime which will be punished in kind.
  • Retribution has its basis in religious values, which have historically maintained that it is proper to take an "eye for an eye" and a life for a life.
  • For the most cruel and heinous crimes, the ones for which the death penalty is applied, offenders deserve the worst punishment under our system of law, and that is the death penalty. Any lesser punishment would undermine the value society places on protecting lives.
  • The measure of punishment in a given case must depend upon the atrocity of the crime, the conduct of the criminal and the defenceless and unprotected state of the victim. And I am definitely aganist the fact, that a criminal who has committed a cruel crime like killing someone intentionally or indulged in violent crimes against women,to be sitting in a prison and been given meals to eat.
  • Such people cannot be called humans and therefore deserve capital punishment to give out a message to any future criminals. Also instant death is something which they do not deserve, they need to suffer for their wrong doings and then get death penalty.

Economist Steven Landsburg argues that if one believes in the death penalty for murderers because of its deterrent effect, using cost/benefit analysis we should execute computer hackers - the creators of worms and viruses - because the deterrent effect in cost saving would be greater than the deterrent effect in saving lives. Estimates are that each execution deters eight murders, which, if one valued each life at about $7 million, saves about $56 million; he estimates that executing hackers would...
