As a marketing manager, you have recently turned down Nancy Conrad for a position as sales supervisor. Nancy believes the denial was due to her gender, and she has filed a sex discrimination charge with the EEOC. Explain the steps the EEOC will use to process the charge; include Nancy’s options during the process.
Answer:-
To start the way toward filing a sexual discrimination charge with the EEOC, Ms. Conrad would initially have to contact the EEOC within 180 of the episode. When all paper work is finished, The EEOC will send duplicates of the claim to both the company and the accuser (Ms. Conrad). After a complaint has been formally filed, the EEOC would start an investigation in the company.
During the investigation the EEOC may ask that the company give them a statement of the position, which will allow the company to safeguard itself, and also state what they accept happened. At this time the EEOC will also obtain a statement from the accuser of what they accepted happened.
The EEOC will at that point carry out an on location visit allowing them to discover what may or may not be honest. They may also demand the contact information for the observer interviews. The EEOC will speak with the administrative faculty and individuals in non-management to get more facts in regards to the case that may be useful.
When the investigation is finished, the EEOC can decide whether there is or isn't reasonable cause supporting the discrimination claim. At this time one of two things can happen. In the event that there is no reasonable cause for the EEOC to push ahead, they will give Ms Conrad a dismissal and rights notice educating her that she can record a lawsuit in 90 days.
On the off chance that there is justification in Ms. Conrad's claim, both she and the company will get invitations to a gathering meeting so as to discover an answer for the claim. In the event that the gathering fails between the company and the accuser, the EEOC will force its statutes' violation by filing a legal dispute in the federal court.
