As we all know that discrimination in the workplace is still happening in many places even in developed countries as well. If you feel harassed by someone or discriminate by someone then these steps and procedures will help you.
1. Never appreciate the wrong behavior.
2. You must collect the evidence
3. You must educate yourself on your legal rights
4. File a claim
5. You may contact with an advocate
1. You must never appreciate the wrong behavior, the first step you must need to take is to ask the perpetrator to stop. If you do not appreciate the behavior of others or stop the perpetrator then he might get an idea that you felt harassed or you have some problem with his actions. Sometimes. a little conversation can resolved the issue so it is important to stop the perpetrator or never appreciate wrong behavior.
2. If a person continuously harassed you even after what you ask to stop then collect the evidence such as video or call recording if someone harassed you via email then save his messages. You must gather all the information what is possible for you then speak with your higher authority or supervisor.
3. You need to aware of the company's discrimination policy, just follow the company's internal protocol before going to employment equal opportunity commission(EEOC). You must present evidence to the supervisor or human resources that request them to investigate.
4. If you realized that no one is listening to you in your office then you can file a charge for discrimination with the commission (EEOC). There is a time limit to file a charge with the commission that you must file a charge within a year. After your charge is filed, the commission will start the investigation, will notify your employer and request them to participate in the mediation process to resolve the dispute.
5. If the mediation process unable to resolve the matter then the commission will issue a notice of Right to use, when the notice is issued, you may file a lawsuit in the prescribed time. In the meantime, you will contact your advocate and he/she will provide you the guidance regarding the legal process. You must show him/her all the evidence you have gathered and all about mediation proceedings.
