As a result of a Supreme Court decision of 1982, states are expected to provide students without legal immigrant status with public education at K-12. The State of New York honors this decision. SUNY's tuition policy states that undocumented aliens who have attended and graduated from New York high schools for at least 2 years may qualify for the in-state tuition rate. Illegal immigrants, however, do not apply for the Tuition Assistance Program (TAP).
Helath- A proof of citizenship is required in order to qualify for Medicaid, unless a woman is pregnant or the case is deemed a "medical." New York State law requires hospitals to treat anyone who needs emergency treatment. "Continued" coverage is not protected by federal law.
Labor. Illegal immigrants, although not unemployment benefits, are
eligible for workers 'compensation. Legislation on labor conditions
also also extends to illegal immigrants, such as minimum pay,
working hours or prevailing rates on public building projects.
Mental wellbeing. It is the responsibility of hospitals to treat patients with emergency medical conditions including mental illness.
Welfare. It is not clear if illegal aliens will get State benefits. The short response appears to be that they are not legally entitled to certain benefits, but are currently earning those benefits.
