The three constitutional issues that the Supreme court has ruled out in the 21st century relevant to legal psychology are :
1. The most controversial decision of the court let to Bush v. Gore pointed the inclination of the justice in the political and public consciousness. This decision led to a bitter divide between the justices which were liberal and the justice which were conservative ( leading to dramatic outcomes for America).
2. The issue of nomination and confirmation raises the most controversial nominee like Hugo Black in 1937. At that time, the process of confirmation had less political salience. However, nowadays, the news media cover all information concerning the Supreme Court nominees which increases the political salience of the confirmation.
3. The third issue is the politicization of the process of confirmation has become more controversial and dramatic due to the increased involvement of various interest groups in aggressive behavior. These groups have attempted to influence senators towards their viewpoint, but the groups organized public relation campaigns which were aggressive in nature to accumulate the support of the public by showing nominees as either helpful or harmful towards the political goal. The political goals may involve the state's rights, women's rights, law enforcement, and immigration, etc.
4. The political process can be polarized which can have a heavy influence on the process of confirmation. This can make parties distant from each other or they can become unified internally.
Thus, these four issues are highly controversial issues in America and increased public awareness can resolve these issues.
