Courtrooms have defined discrimination through various decisions, setting precedents, over the years. The two specific types of discrimination that exist today are disparate treatment and disparate impact.
Disparate treatment is where an employee makes claims that he has been discriminated or treated different intentionally in a workplace but not the other employees because he has an unique characteristics from them.Disparate impact is the unintentional discrimination that occurs on workplaces to a minority group of employees. The minority group receives more discrimination than the non-minority group of employees.
Explanation:
The disparate treatment recent example is Mr. Inam suing Nike for racial discrimination where he gets less pay that other employees. Mr. Inam also made complaints of hostile treatment and discrimination because of his race.
The disparate impact recent example is women suing Walmart for discriminating women in terms of payment and promotion. This made the stakeholders to agree to pay the women the same as men and get equal opportunities to job promotion.
If I was the manager fist is i will do investigation in the claims and if the claims are true i acknowledge the claims to those complaining. The second step is to ensure that the problem is solved in the company does not go to the courts. If the company is on the wrong side i urge them to pay compensation for the discrimination and prevent similar cases from happening again.
