Description of one contract that will be necessary for our photography business is as below

Portrait Agreement/Contract:

This is the start of the relationship between the client and the photographer in the photography business. Portrait agreement is a contract between the client and the photographer for the photography work , it starts with general things like the date of event, rates for the photography, payment terms, cancellation policy etc. This agreement creates the initial relationship between the client and the photographer and includes all the key requirements of both the parties. This agreement defines the expectations of each other and understanding policies for their business. This is agreement/contract written and signed off by both the parties, which gives the evidence that both are OK for the contract of photography service.

Elements of Portrait Contract for photography are as below

  • An Offer: Portrait contract will have an formal offer from the photographer to the client for the photography request based on the request from the client. This offer is a valid legal document as a proposal from the photographer to the client against the request of client. This offer will have the formal signature of the service provider and it will be on the letter head of the service provider.
  • An Acceptance: An acceptance is the written sign off by the client against the offer received from the photographer to the client. When the client signs off the offer, this means he is OK for the contract and will be liable for compliances.
  • Considerations: These are the policies and conditions to be consider in the contract. This will be basic terms and conditions for the agreement.

These three key elements of the portrait contract makes it valid and binding the photographer and the client for the agreement. Thus

Independent Contractor Agreement:

This is agreement / contract applicable in the business when pairing up with someone else to support the business as per our requirements like shooting person, designer, etc. Thus an independent contractor is a third person that provides the goods / services to the photographer as per the terms and conditions of the photographer business person. Thus basically independent contractor is sub contracting the photography business activities. Unlike the employee, this independent contractor does not work full time , but they work as and when requires for the business. Adequate policies and expectation are helping tools for longer/smoother relationship with the independent contractors.

Protecting Copyright: The photographer can have copy right act contract with the client when he provides the digital copies of the photography to the client. This helps the photographers.
