Since this brand was originally trade mark registered by Mixed Chicks and the trade mark was already registered, therefore copying this or any thing similar to it was case of infringement. Actually it was will full, Malice and Oppression. Therefore Jury found the evidence in favor of Mixed Chicks as they were able to prove that this has been started with them with proper trade mark registration, therefore any other entity cannot be allowed to do the similar representation as per trade mark law.

Steps which a small business can take up to protect their brand is as follows

1. Register the trade mark of brand name or logo

2. Protect your web content, They may use DMCA copyright

3. Try to develop a distinctive mark

4. Always use IP protection

5. Keep Global orientation

6. Keep a close watch on your competitors and report before the damage is done.

7. Run the business ethically

8. Meet the legal requirements of the business
