What is a “penumbral” case in the law? How does this relate to Heath’s view of corporate social responsibility?
A "penumbra" case would be the one, where a judge interpreting such a law from a positivist viewpoint would look to a definition of the words in the statute. In United States constitutional law, the penumbra includes a group of rights derived, by implication, from other rights explicitly protected in the Bill of Rights.
In CSR, it is a self-regulating business model that helps a company be socially accountable—to itself, its stakeholders, and the public. when we compare CSR with Penumbra it has an implication on its implementation and to protect the business law with the social welfare .derivation of protection of the law itself is protected by the law. Contrastingly, the broader view of Corporate Social Responsibility states that other than the main objective of gaining profits the businesses and organizations have a responsibility towards the communities where they operate and to address the negative consequences of their businesses on the society. the concept of a corporation as a socially responsible entity conscious of the influences it has on. CSR, when conducted in good faith, is beneficial to corporations and their stakeholders.
If we will examine penumbra itself the constitutional law has permitted the corporate law to behave ethically to derive the optimum social welfare. so the law itself protected by law and represented the growth or the implementation and extention by decribing the pattern of law.
