Your organization is an organic food supplier with employees in the following jurisdictions:

Yukon
The organization is planning to implement a company-wide policy with respect to vacation leave and vacation pay that provides the same benefits to all employees, regardless of their province of employment. As the Payroll Supervisor, provide Susan Fraser, the Human Resources Manager, with the following information:
Identify four specific items relating to vacation leave and vacation pay that will have to be addressed in the policy to ensure compliance with the employment/labour standards in each jurisdiction.
Research the details for each of the items you have identified using the course material and the employment/labour standards website for each jurisdiction.
Using the results of your research, provide your recommendations to Ms. Fraser on how to address each of these items in the policy to provide the employees with the best benefit, while keeping the cost to the organization at a minimum. Explain your reasoning.
Solution
This is the Labor Law in Both the Jurisdiction, a Paid leaf differs. In Manitoba Law allows 8 days as paid leaves whereas in Yukon, Law allows 9 days as paid leaves. Therefore, as we have to follow laws of particular jurisdiction, paid leaves will be more beneficial to employees in Yukon because that is one extra leave they will get as compared to Manitoba.
The Employees of both the Jurisdictions will get 5 festive leaves( New Year's Day, Good Friday, Labor Day, Christmas Day, and Canada Day) which is more beneficial for employees and will have negative effect on our company's productivity if these days come over Saturday and Sunday then they will get following Monday as holiday as per law. For our company's benefit, we can make predict and make adjustment for the same before year starts as which festive leaves came over Saturday and Sunday and therefore take reasonable actions along the same which will increase companies’ productivity.
In Manitoba, jurisdiction requires that the employee be paid their holiday pay (one day's regular wages) in addition to 1.5 times their regular wage for hours worked on the holiday. Whereas, in Yukon they give the option of being paid regular wages plus 1.5 times the day's wages or getting paid for the day and receiving another day off later. Obviously extra salary which employees get for their work on holiday is an opportunity cost for our company because we can make work done at normal wage rate in week days as well.
Paid vacation for employees exists in all employment standards legislation in Canada. In Yukon, the vacation time starts at two weeks per year for an eligible employee, and grows to three weeks after a mandated amount of years have passed at the job which mainly depends on employee work growth and company to company whereas The vacation increases to three weeks of vacation per year after five years of work in Manitoba.
Manitoba pays 4%-6% of annual pay as paid vacation where as Yukon pays 4% of annual pay as paid vacation. Leaves for extended periods of time are generally unpaid, with very few limited exceptions. Common leaves in Canadian jurisdictions include maternity, parental, compassionate care, sick, and bereavement leaves.
As per those standard laws and regulations, my recommendation for the benefit of both employee and employer to HR will be as follows:-
We will make a more strict policy regarding accuracy of work and then vacation pay and vacation leave will depend on their work growth and consistency. By this strategy we can get to know how much individual employee is doing work with determination and Increase Company’s growth. We can increase the vacation pay or leave as well as per the individual report. By this we will not violate any law but in return will get employee satisfaction along the work which will in turn increase company's value. There may be difference in recommendation because of difference of opinion of others as well.
Along with that we have to take care of these below points as well which combine with Law-
2 For our company, Manitoba will be more beneficial to do business because of only 8 days shall be allotted to employee as Paid Leaves compared to Yukon which provide 9 days, 1 day for all employees will have a great effect in terms of cost to company. It is vice-versa for employees because they need more days as paid leaves.
3 for our company's benefit, we can predict and make adjustment for the same before year starts as which festive leaves came over Saturday and Sunday and therefore take reasonable actions along the same which will increase company's productivity. It is again vice-versa for employees because they get more leave and pay if festive days came over Saturday and Sunday as Monday’s off.
