Medical consent is a requirement by law that the patient must agree to be examined or treated by a physician. Consent can be given orally, implied, and/or written. In a one to two page summary, describe under which circumstances the patient should never sign a consent form. Explain why in these situations the medical administrator should never enforce the consent form. Also, describe how the medical administrator should follow-up these situations.
CONSENT
Consent is a permission of a person before they receive any type of medical treatment ,test,or examination .before taking this consent from a person for medical treatment should be given adequate explanation .consent can be given orally,implied ,written.
WHICH CIRCUMSTANCES THE PATIENT SHOULD NEVER SIGN A CONSENT FORM
It includes ,
1.EMERGENCIES
In an emergency situation like accident ,heart attack,etc a doctor must act quickly to save the life of the patient .in these situation if a doctor expalinig the condition to the patient or the risk of procedure or if stopping life saving efforts will cause a delay of the treatment and tha cause to increase the further risk of the patient .in these situation health care team can manage without consent .
2.THE PATIENT IS UNCONSCIOUS
A patient who is unconscious cannot give consent . it includes ,
-Unconscious due to oxygen deprivation .
-Shock.
-Central nervous system depressents such as alcohol and drugs or injury.
This patients cannot sign the consent form ,because they seem like they are sleeping,but may not respond to outside events ,such as loud noise or being touched or shaken.
3.THE PATIENT IS MENTALLY INCAPACITATED OR EMOTIONALLY FRAGILE
If a doctor knows that his patient is so distressed that he or she will refuse treatment ,the doctor may not be required to get the patient consent .or if a doctor believes that the details of procedure will make to increase the anxiety of the patient
the patient includes,
-Mood disorder patient ,bipolar disorder,depression,phobias,OCD,panic disorder,anxiety disorders
-Personality disorders
-Post traumatic stress disorder.
-Psychotic disorder including schizophrenia.
-Eating disorder.
WHY IN THESE SITUATION THE MEDICAL ADMINISTRATOR SHOULD NEVER ENFORCE THE CONSENT FORM
If the patient unde these circumstance (emergency,unconscious,emotionally fragile) the medical administrator should never enforce the patient for consent ,because it will cause the delay of the patient treatment .and if stopping the life saving efforts (for the explanation of consent ) will increase the further risk of the patient condition .
in an emergency situation ,if the patient unable to provide his own consent ,consent is presumed and treatment is provided absent direction to the contrary (a living will or durable power of attorney for health care or other such form )
HOW MEDICAL ADMINISTRATON SHOULD FOLLOW UP THESE SITUATION
A doctor has some obligation to follow on a non adherent patient .if the patient not signed his consent form because of emergency situation ,unconscious etcthe doctor or medical administration may have more of an obligation to follow up.Remember to always document in the medical records any follow up calls to a patient or patient gardians ( if children)or other own close relatives like father mother etc.
