Contract for the Sale of Used Car

This is a contract made between the Seller, Mark R. Conrad, and the Buyer,

Aaron Rodgers, for the sale of Seller’s vintage 1980 Jaguar four-door sedan in electric silver with sunset red leather interior.

The VIN number is 007-1950-BRLN-JLO-1971, and the odometer reads 173,000 km.
as of July 11, 2018.

The date of sale is July 14, 2018. Buyer agrees to pay to Seller the purchase price of $8,975 to be paid by a certified check issued by Wells Fargo Bank N.A., Minneapolis MN.

The car is sold “AS IS.” Seller makes no warranties about the condition of the car.

Seller will provide the Buyer with the vehicle’s title and the past twelve months service records.

Dear Aaron,

As was discussed, I was going over the case and was contemplating the terms and conditions which must be included in the contract to be signed with Mr. Mark R. Conrad.

A contract can be considered valid if it has the following components:

  • Offer
    • In this case, the offer is to buy the used car in as is condition, offered by Mark Conrad
      • The car is a vintage 1980 Jaguar 4 door sedan car, offered in electric silver color with sunset red leather interior.
      • VIN number of car is 007-1950-BRLN-JLO-1971
      • The odometer of car reads 173000 km as on July 11 2018
      • The seller will provide the buyer with vehicle’s title as well as past 12 months service records
  • Acceptance
    • We are ready to buy the car in the as is condition
  • Intention to create legal relationship between the involved parties
    • Both the involved parties are ready to get into the legal agreement regarding this sell and buy of the car
  • Consideration
    • We have offered a consideration of $8975 for the car, which will be paid through a certified check issued by Wells Fargo Bank.
  • Competency and capacity
    • The seller is making no warranties about the car and its condition and the buyer is ready to buy the same with the same competency

In my views, buying such an old car which has run quite a lot, with no warranty of the car condition is a risky deal. We have no clue how the car will perform in the coming days. Moreover we have not taken a test ride of the car and have no knowledge about the fuel consumption. If the objective of buying this car is just to add it in your car collection, then you must go head with the contract. However if you have plans to use the car for personal purpose, I would suggest you to kindly revisit this plan as the stakes are quite high.
