On September 2, 2015, Mary and her son, Robert, went shopping for clothes at the local "Q" Mart store. Once inside, Mary made numerous selections, placed them in her shopping cart, and made her way through checkout, paying approximately $800.00 for the merchandise. Unknown to Mary, however, was the fact that Robert, age 4, had taken 2 bags of candy from a rack and placed them under his seat. After exiting the store, Igor, the Chief of Security for "Q" Mart grabbed Mary and Robert, threw them both to the ground, kicked them in the head, and placed them both under arrest. The police were called to the store where Igor stated that he saw Mary take the candy and hid it under her child. "Q" Mart also called the news media and took out ads supporting their position.
At criminal court, the criminal case against Mary was dismissed when witnesses testified that Mary took no candy and knew nothing of what her 4 year old son had done.
Explain in detail what cause or causes of action Mary could file on her and Robert's behalf against the store and/or the security guard.
Inthe above case of Mary and his 4-year-old son Robert, according to me Mary is completely innocent as she was completely unaware of the fact that his son has taken those two boxes of candy with him. She had already taken the things in her shopping cart that what we wanted to buy. She shouldn´t be fined or charged for this case. That 4-year-old boy took those boxes of candies and he also wasn´t aware of all these because he is just a 4-year-old small kid. It was just a mistake by that kid. The Q Mart has done completely wrong with Mary as they called police and news media without knowing the truth. Also they are blaming Mary that she took the candies. To clear this fact the police should check the CCTV footage of that Q Mart of that particular time. It will be cleared with the footage that she had not taken the candies herself. It was taken by that 4-year-old kid. The court should listen to Mary too and with the help of evidence they should make a decision. Here Q Mart had done completely wrong with Mary and for that he should be fined and compensation should be delivered to Mary for all the inconveniences she faced over there.
