Tests of Legal Sanity?

I have been operating as the criminal justice adviser for about a year now at the state of Chaos. I would like to give some views on dealing with cases involving insanity basis. There are some concerns that insane people should be released while some arguments pressing that these individuals should be detained while being investigated whether they are sane or insane. As per now, there are about 22 people with cases pending but still have sanity and insanity issues. The government is trying to treat these people by drugs with an aim of determining whether they will be able to know acts and all charges placed on them so that from if the treatment is successful they will be judged like normal people else be send to medical school. I think the issue of insanity is very complex and the defense team should consider all the factors before medicating an individual while on the other hand, the government should determine if an individual is insane or not before, dangerous to himself or even others before proceeding with any charges or case.

Sanity determines the competency of a defendant to face a trial. The defendant must be able to understand all the legal proceedings placed against him. The defendant be also be able to clearly understand all the roles of different personnel at the court, the defendant must also be aware by what it means by being guilty and being innocent. The defendant must also be aware of the respective outcomes of being guilty and also being innocent. The defendant should also be able to defend himself or herself. This entails being able to work with their respective lawyers and attorney. If an individual meets all these tests, then he or she qualifies to be mentally sane hence fit to face a trial placed before him or her.

The legal definition and requirements of sane is that, a sane individual performs act knowingly, with a clear purpose and he or she is well aware of any legal consequences that might pop up with his or her action. Sane individuals understand all the legal proceedings placed against him. Sane individuals remember all the events that took place during the commitment of the offense. Sane individuals are very much aware of legal weight associated with their cases and respective outcomes if found guilty or innocent. Hence sane individuals are able to cooperate with all parties involved in courts to defend themselves.
