Which is more important—to ensure that only relevant and probative evidence is admitted into court OR to ensure that irrelevant, unreliable, and prejudicial evidence is excluded from the courtroom? Explain your answer.
Ans
To ensure that only relevant and probative evidence is admitted into court is more important because they are admissible in the courtroom. Before starting a legal proceeding, a judge has to ascertain that if evidence is relevant with respect to case. Therefore, if we exclude irrelevant, unreliable, and prejudicial evidence is excluded from the courtroom the it will streamline the proceedings, and judge time will be saved from unnecesary task of determining if the evidence is correct or not.
