Lab Instructions

Class Activity:
Read the following scenarios below, then decide based on the situation whether each instance is a ROBBERY, BURGLARY, THEFT (petty or grand) or NOT ANY OF THESE CRIMES.
Use your textbook and the internet to research and determine what charges if any may be filed.

1. A man borrows his neighbors’ car with permission. While he has the car out he accidentally locks the keys in the car. Being in a hurry, while trying to get the window down enough to reach inside he shatters the window.

2. A woman is hungry and asks a man for some change. He acts like he is going to give her a five dollar bill, but then refuses and laughs at her. As he walks away, he still has the five dollar bill in his hand. Before he can return it to his wallet the woman leaps up, grabs the five away from him, and shoves him back before running off.

3. A woman wants to mow her lawn, but her lawnmower will not start. She sees that her neighbor has a lawnmower setting on the side of his house. There is no fence or gate, but it is placed against the house and out of view from the street.
The woman takes the lawnmower from his yard, mows her lawn, and returns it after filling the gas tank.

4. A man is walking by a house where he hears the fellow inside yelling at his wife. The man stops and listens a minute, and becomes angry at how cruel the man who is yelling is being. In a moment of rage, the man rushes up, kicks open the door, and yells “pick on someone your own size!” When the homeowner stands to confront the guy who kicked in his door, the first man punches him in the face before running off.

5. A 13 year old boy knows his dad keeps his whiskey bottle locked in the work shed. The boy sneaks into his parent’s room, takes the keys, and then goes into the work shed and takes the bottle. He drinks half of it with his friends, and then decides to return what is left to the work shed.

Solutions

Expert Solution

1. Not any of these crimes ( as he did this to get the keys back and we can suppose that he or she may pay back the cost for repairing of the window)

2. Theft ( petty) Property Value and Severity of Theft Penalties

States often place a specific dollar figure, such as $500 or $1,000, as the upper limit for petty theft charges. These charges are typically misdemeanors that carry fines or relatively short jail times typically less than six months, but certainly less than one year.

Different states have different rules you can refer to the internet related to the charges .

3. THEFT (petty) . Taking someone's property without their permission considered as theft ,and assuming the lawn mower is costing less than 500$ , if more you can choose between grand or petty .

4.  NOT ANY OF THESE CRIMES. If we talk about the man who was yelling he can be charged with "Harassment ".

5. I m not clear about the 4th one but maybe it will be also petty theft.

If you feel i failed in answering your question completely please comment and let me know and i will do more research and will edit the answer but don't downgrade as if you do the same my account will be revoked , hope u understand . Thanks .
