In a recent high-profile court case from the past 4 years, what are 2 factors of the trial that could prevent the defendant from receiving a fair trial?
The right to a fair trial is a norm of international human rights law designed to protect individuals from the unlawful and arbitrary curtailment or deprivation of other basic rights and freedoms, the most prominent of which are the right to life and liberty of the person (quote). A fair trial can be impeded by the folowing two main factors:-
1. In high profile court cases involving public figures or suspects arousing mass hatred PRETIRAL PUBLICITY with media breaking down the entire case detail into peices is an effective factor which can influence the jury who will also be reading media highlights of the case.
2. WITNESS INTIMDATION or Witness tampering is the act of attempting to alter or prevent the testimony of witnesses within criminal or civil proceedings. Especially in high profile cases where a public personality is being tried, witness frieghtining or pressurising is very common.
