rights of the criminal defendants are as follows:
The fourth amendment states that: it is required that there should be a probable cause so that any seizure could be carried out or for any search to be conducted.
Fifth amendment rights: in this, the criminal defendant would be having the right to remain silent, where, the defendant would be protected from self incrimination. This is also referred to as the Miranda rights and these are declared at the time of arrest and also announced during trial. Also, there is a right against double jeopardy where the same person cannot be tried for the same crime a second time.
6th amendment rights: these would be allowing the defendant the right to representation, where, even if they wouldn’t be able to afford a lawyer, they would be provided now by the government. Also, there is the right to speedy trial in which the government cannot in any form conduct secret trials. Also, they can also be tried by the Judy if they want.
Eight amendment rights: here the defendant would be having the children right to obtain bail with respect to their crimes. All, they should not b subjected to any forms of unusual punishment.
