According to The Juvenile Justice and Protection of Children) Act, 2000, Section 83 of the Indian Penal Code, according to which, nothing is an offence which is done by a child above seven years of age and under 12 years, who has not attained sufficient maturity of understanding to judge the nature and consequences of his conduct on that occasion. It may be noted that children below the age of seven years are deemed to be incapable of criminal offence as per section 82 of the Indian Penal Code. The child rights are essentially Human Rights and need to be put in place given the vulnerability of this population in the world. Therefore, in the given above protocol by law, it must be questioned as to whether or not the child has attained maturity to take life's decisions based on their own unique life narrative In case of this and seriousness or intense gravity of the offense, this must be challenged and the trial must be executed like that of an adult. §In many societies, views persist that children are their parents' property, or are adults in the making, or are not yet ready to contribute to society.

• Children contribute to the progress of the society, yet they cannot take part in the political process or use the legal system.
• Being one of the most vulnerable group, children are subjected to torture , starvation , servitude, commercial exploitation, terrorism, humiliation, mutilation, neglect, abandonment, abuse and even murder simply because they are children.
• Many children are caught in the web of poverty, ignorance and deprivation, thereby not able to attain their true potential. According to the UN conventions, the basic rights of children to be protected are that of: Survival, Protection, Development, and Participation. Although many of the rights are ensured by the policy put in place, it's proper implementtaion and spreading the awareness of such rights in the more inaccessible areas of the society are a must. Campaigning and a lot of propagation through networks and channels including NGOs and other established institutes promoting the welfare of children should be taken into loop for the same.
