Discuss whether administrative agencies have too much power. Why or why not?
ANSWER:
GIVEN THAT:
THE ADMINISTRATIVE AGENCIES HAVE TOO MUCH POWER:
1. The administrative agencies were created by the federal constitution and other entities like state legislatures, congress and the local law making bodies for the management of different types of serious social problems, management of crisis and to take care of the complex governmental matters that are beyond the expertise of the legislators.
2. They have an authority to affect the rights of the private parties. They perform basic functions of rule making and enforcement and resolving the controversies.
3. The powers they are vested with are not too much but are the essential for their functioning.
4. The roles that they play require the powers like framing the rules and enforcing them, resolving the disputes and so on.
5. If these powers are not given to them, they will not be able to perform their roles.
6. The administrative agencies are created through legislation and these legislation also defined the framework of rules and limitations within which these agencies need to work.
