HEB has faced a controversy during a personal injury suit against HEB filed by Daniel Rodriguez. Rodriguez fell over an unsecured metal plate in front of a grocery cart corral in HEB parking lot. He alleged that as a result of HEB’s negligence he had undergone injuries on knee, arm, face, neck and shoulder and received medical treatment including two spinal surgeries. He required additional spinal surgery and when the suit was pending, he involved in an accident from Sam’s club and got injured. Rodriguez filed suit against Sam’s club as well. After the incident, HEB’s orthopedic surgeon, Dr. William Swan provided report about Rodriguez’s injury that Rodriguez suffered from preexisting spinal condition only based on his medical reports without examining Rodriguez. Based on Swan's report HEB filed a motion requesting physical examination of Rodriguez by Dr. Swan and Dr. Swan also filed affidavit based on the motion. The trial court denied the motion pointing out HEB’s failure to provide sufficient evidence.

HEB gives back to the community through their community programs and environment sustainability efforts. Each year HEB rewards $700,000 in cash prizes to deserving teachers, principals and school districts for excellence in education. HEB also conducts fund raising programs for the schools. HEB has delivered more than 935 million pounds of food, non-foods, perishables, over-the-counter drugs, pastries and bread to food banks. They also support environmental programs and they have partnered with Ocean Trust to restore estuarine habitat for the seafood sustainability. HEB also uses sustainable practices to conserve natural sources while conducting business. They try to reduce pollution through adopting reduce, reuse, recycle strategy. The landfills are also reduced and diverted organics to compost and animal feed. The plastic usage also is reduced significantly. They use fuel saving strategies and reduce the green house gas and other harmful emissions to the atmosphere which helps the community in its sustainability efforts.
