Joshua has repeatedly teased and harassed Colin at their high school. On one occasion, Joshua and some other people abducted Colin and tied him to the flag post, partially nude, for everyone to see. Colin wanted to get even, so he decided to scare Joshua. One morning before school, Colin drove his car at high speed directly at Joshua, intending to stop just before hitting him. Colin couldn’t stop in time, however, and Joshua was killed instantly. Answer the following questions:

  • Could Colin be charged with murder, voluntary manslaughter, or involuntary manslaughter? Why?
  • Could the length of time between the ongoing provocation and Joshua’s killing be a factor in how Colin is prosecuted? Why or why not? What other factors might affect this case?
  • As a Christian, how can you spot signs of bullying, and how can you address these issues in a way that honors the dignity and cares for the souls of all parties?

Solutions

Expert Solution

Ans. 1. Colin will be charged with involuntary manslaughter. Involuntary manslaughter is an act where the person has no intention to kill. Colin wanted to scare Joshua he wanted to stop the car just before hitting him, as he could not control the car and drove directly on him killing him instantly.

Colin's age is not mentioned, He is a high school student means he can be between the ages of 14-18 years. If he is under 18 years of age he will be tried under juvenile court.

2. No, the time length of time between the ongoing provocation and Joshua's killing will not be a factor. The conduct shown by Colin is the total disregard for the other person's (Joshua) life safety. With time he should have let the matter go but he planned to scare him and accidentally killed him

3. Christianity teaches us to love all human beings because humans are supposed to be the image of God. Harassing and bullying are against the teachings of Christianity. These issues could be solved by bringing both the boys together to understand the problem. They should be taught what religion wants from human beings.

We have come to the world to thank God and ask for his love and mercy on us. Dignity is a person's honor and respect and everyone loves to have his dignity. By bullying others one tries to lower his dignity thus it is important to make other respect and honor others identity.

You describe reliability evidence that test publishers typically present for their tests. You emphasize that, as consumers of tests, high school teachers and principals need to pay attention to that evidence and evaluate it.
